These Terms of Use constitute a legally binding agreement between you and Skillmint AI, a UK-based company, governing your access to and use of our website, platform, and services (the "Platform").    "User" or "you" means the individual or entity accessing or using the Platform, including hiring organisations, recruiters, and candidates.
   "Content" includes all information, text, files, data, and materials submitted to or displayed by the Platform.
   "Services" means the features and functionality made available by Skillmint AI, including AI-generated candidate interviews, summaries, and analytics tools.
    

2. Acceptance of Terms
   By using our Platform, you confirm that you are at least 18 years old, legally capable of entering into contracts, and you agree to comply with these Terms. If you do not agree with these Terms, you must not use the Platform.
    

3. Our Services
   Skillmint AI provides AI-powered recruitment tools, including automated candidate interviews, scoring, transcriptions, and dashboards for recruiters and hiring managers. Skillmint AI does not make hiring decisions. Our platform provides structured insights and recommendations to support recruitment teams, who remain solely responsible for any decisions or actions taken based on the Platform's outputs.
    

The Platform may be accessed by both hiring teams and job candidates, each of whom interact with different features of the system.

We may update or modify our services from time to time. We reserve the right to discontinue any feature or part of the Platform without notice.
 

Skillmint AI uses a variety of third-party technologies to deliver and enhance its services, including but not limited to:

OpenAI (GPT-4o, GPT-4o mini, o3 mini, DALL·E)
Claude (Anthropic Sonnet 3.5)
AWS (EC2, Lambda, API Gateway, S3, DynamoDB, CloudFront with WAF, Amplify, Cognito)
Google Cloud (Cloud Storage, Vertex AI, Text-to-Speech)
Potential third-party tools such as ZeroGPT for content verification

These services are integrated with safeguards to ensure compliance with privacy and data protection laws.

AI-generated outputs may occasionally contain inaccuracies or unexpected phrasing. We recommend users review all AI-generated content critically before using it in any formal decision-making or communication.
 

Skillmint AI is classified as a high-risk AI system under the EU Artificial Intelligence Act. We maintain appropriate documentation, logging, oversight mechanisms, and fairness checks in line with applicable regulatory requirements.
 

1. Registration and Account Security
   You may be required to register for an account. You must provide accurate, current information and keep your login credentials confidential. You are responsible for all activity under your account.
    

2. Acceptable Use
   You agree not to:
   Use the Platform in any unlawful way or for any unlawful purpose
   Reverse-engineer or tamper with any part of the Platform
   Attempt to access accounts or data not belonging to you
   Upload malicious code or interfere with platform operations
   Circumvent any content protection or access controls
    

3. Intellectual Property
   All content and features on the Platform, including AI tools, designs, text, graphics, and branding, are owned by Skillmint AI or our licensors. You may not reproduce, distribute, or exploit any content without our written consent.
    

4. User Content and Conduct
   If you submit, upload, or transmit data to our Platform (e.g. interview answers, CVs, notes), you retain ownership of your content but grant us a licence to use it for the purpose of delivering and improving our services.
   
   You confirm you have the right to upload all content, and you must not submit any content that:
   
   Is unlawful, defamatory, or discriminatory
   Infringes on others’ rights or privacy
   Contains personal data you do not have permission to share
    

If you are a candidate, you are responsible for ensuring that the content you submit (e.g., video interviews or uploaded CVs) does not contain personal data that you are not comfortable sharing with the hiring organisation.
 

1. Data Protection
   Your use of the Platform is also governed by our Privacy Policy, which outlines how we collect, process, and protect personal data in accordance with the UK GDPR and Data Protection Act 2018. By using the Platform, you agree to the terms of our Privacy Policy.
   We retain personal data only as long as necessary for the purposes described in our Privacy Policy, unless a longer retention period is required or permitted by law, contractual obligation, or client request. Candidate data is generally retained for at least 12 months, but this period may be extended depending on the nature of the service or client requirements.
   Clients and candidates may request deletion of their data at any time, and we will comply unless we are required to retain it for legal, regulatory, or operational reasons.
    

2. Third-Party Services
   Skillmint AI may integrate with external tools (e.g. Applicant Tracking Systems). We are not responsible for third-party platforms and their terms or data handling practices. It is your responsibility to review and accept any applicable third-party terms.
    

3. Service Availability and Force Majeure
   We aim to keep the Platform available and running smoothly. However, we do not guarantee uninterrupted access and may occasionally experience downtime due to maintenance, technical issues, or events beyond our control.
   We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, internet outages, government restrictions, or cyberattacks.
    

4. Payment Terms
   Currently, payments are handled via third-party processors such as Stripe. All payment processing is subject to the applicable terms of the payment provider.
   We reserve the right to introduce or update payment terms in the future, including subscription fees, billing cycles, or invoicing options, and such terms will be clearly communicated and subject to these Terms.
    

5. Warranties and Disclaimers
   The Platform is provided "as is" and "as available" without any warranty of any kind, whether express or implied. We do not guarantee that the Platform will be error-free, secure, or meet your expectations.
   To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
    

12A. Use of AI and User Responsibility

Skillmint AI uses automated tools to assist in candidate screening, including AI-generated interviews, summaries, and matching insights. These tools are intended to support, not replace, human judgement. Final hiring decisions are the sole responsibility of the hiring organisation or user.
 

You understand and agree that Skillmint provides a decision-support platform. While we aim to ensure accuracy and fairness, we do not guarantee the correctness, completeness, or suitability of any AI-generated recommendations. You are responsible for how you interpret and act on insights provided by the Platform.
 

1. Limitation of Liability
   To the fullest extent permitted by law, Skillmint AI is not liable for any indirect, incidental, or consequential damages arising out of your use of the Platform. This includes but is not limited to lost profits, data loss, or business interruption.
    

2. Indemnity
   You agree to indemnify and hold harmless Skillmint AI, its directors, employees, and partners, from any claims, liabilities, damages, or legal proceedings arising from your use of the Platform or your breach of these Terms.
    

3. Entire Agreement and Severability
   These Terms, along with our Privacy Policy, constitute the entire agreement between you and Skillmint AI. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
   You may not assign or transfer your rights under these Terms without our prior written consent.
    

4. Governing Law and Jurisdiction
   These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
